LA JUSTIFICATION DE LA LOI

LA JUSTIFICATION DE LA LOI est le premier ouvrage traduit en français de David Weiss Halivni sur l'oeuvre de toute sa vie. Il présente la synthèse de ses recherches sur le Talmud depuis plus de quarante ans. Il y énonce la thèse princeps de toute son oeuvre: le Talmud, la plus grande oeuvre collective du peuple juif en exil, est pour l'essentiel la reconstruction de sages juifs anonymes ("Stammaïm") qui oeuvrèrent après la période des Amoraïm (après le sixième siècle). Pour comprendre la portée de cette thèse, il faut distinguer dans le texte talmudique, d'une part la loi conclusive, l'arrêté de la loi, et d'autre part, la justification de la loi. Seuls les arrêtés se transmettaient fidèlement et officiellement de génération en génération. Le souci de préserver le fil dialectique de l'argumentation n'émergea que plus tard lorsqu'une nouvelle génération de sages inventa une nouvelle-ancienne forme d'étude. Les Stammaïm reconstruisirent la trame des arguments des sages qui les avaient précédés et inventèrent la sougya du Talmud (l'unité discursive du Talmud dans laquelle une loi est discutée sous la forme apparente d'un dialogue) tel que nous le connaissons. La justification de la loi devint alors la forme d'étude la plus prégnante du monde juif. David Weiss Halivni retrace avec érudition cette histoire étonnante, depuis ses racines dans la Bible jusqu'à aujourd'hui.

Erudit du Talmud, rabbin depuis l'âge de quatorze ans et survivant d'Auschwitz, David Weiss Halivni a été professeur de civilisation juive à l'Université Columbia de New York jusqu'en 2005. Note: le texte qui suit n'a aucun caractère officiel et est fondé sur les notes de Florian Wolfowicz et le résumé de Yitshaq Reiner que nous remercions. Il ne représente que notre propre tentative de comprendre la sougya à partir du cours de David Halivni.

Un home a dit à son prochain: si je vends ce terrain, je te le vends à toi. Il s'en est allé et l'a vendu à un autre.

Rav Yossef a dit: le premier l'a acquis.

Abaye lui a dit: il n'avait pas arrêté le prix !

Et d'où peux-tu dire que dans le cas où il n'a pas arrêté le prix, il n'est pas acquéreur? De ce qu'on a enseigné (dans la Michnah): si un Juif vend son vin à un païen, s'il a arrêté le prix avant de mesurer, l'achat (en argent) est permis; s'il a mesuré avant d'arrêter le prix, l'achat (en argent) est interdit.

Quelle est la loi à ce sujet ? [Quelle est la loi à ce sujet ? Comment peux-tu demander? ] C'est ce que nous avons dit plus haut. Mais peut-être le cas (plus sévère) du yayin nessekh est différent.

Viens écoute: Rav Idi bar Avin a dit qu'un cas s'est présenté chez Rav Hesda et Rav Hesda l'a envoyé chez Rav Houna qui l'a exposé ainsi, car il a été enseigné: si un homme tire les ânes et les ouvriers d'un autre et les emmène dans sa maison, qu'il ait arrêté le prix avant de mesurer ou qu'il ait mesuré avant d'arrêter le prix, les deux peuvent se rétracter; s'il a déchargé (la marchandise) et l'a emportée dans sa maison, s'il a arrêté le prix avant de mesurer, aucun des deux ne peut se rétracter, s'il a mesuré avant d'arrêter le prix, les deux peuvent se rétracter.

La sougya débute par l'histoire et un dialogue entre Rav Yossef et Abaye. Le dialogue est historiquement plausible, Rav Yossef étant le maître d'Abaye. Seule la position d'Abaye est justifiée par la Guemara: la Michnah Avodah Zarah 5:7 est citée à l'appui.

Pourtant notre Guemara poursuit en demandant:

מאי הוי עלה

Quelle est la loi à ce sujet ?

Ce qui semble étonnant, vu que la Michnah a déjà été citée. Effectivement, la question est répétée entre crochets dans notre Guemara, cette fois par emphase et étonnement, comme l'indique Rachi.

Puis la Guemara insiste et affirme que peut-être le cas du yayin nessekh est différent, vu sa spécificité. Nous avons alors un enseignement de Rav Idi bar Avin basé sur un cas concret qui n'a rien à voir avec le yayin nessekh et qui justifie l'opinion d'Abaye.

David Halivni remarque tout d'abord que la justification de l'opinion de Abaye n'est pas énoncée par Abaye lui-même mais est déduite (ou reconstruite): elle est introduite par

ומנא תימרא

que David Halivni explique comme מנא אמינא לה. La justification par la Michnah de la position d'Abaye est donc une reconstruction ou une hypothèse. Cette justification est logiquement plausible dans la mesure où nous voyons que seulement si la fixation du prix précède la mesure (ou le toucher) du vin, la vente (et le fait de recevoir l'argent de la vente) est permise. Mais elle n'est pas d'Abaye et elle fait intervenir le yayin nessekh dans un cas qui a priori n'a rien à voir avec le yayin nessekh.

Il est par conséquent probable, dit David Halivni, que la question

מאי הוי עלה

(qui dans notre Guemara suit la justification) ait été posée avant la justification par la Michnah. Cette question a été posée après la décision légale de Rav Yossef et la réaction de Abayé qui a réagi en soulevant la difficulté (il n'avait pas arrêté le prix). La réponse est alors celle de Rav Idi bar Avin

דאמר רב אידי בר אבין...

qui ne fait aucunement référence aux relations avec les païens et au yayin nessekh, mais est directement liée au cas particulier qui oppose Rav Yossef et Abaye.

Par la suite, celui qui n'a pas vu que la justification par la Michnah est une addition ultérieure à notre texte de la Guemara a lu

מאי הוי עלה

comme nous-mêmes l'avons fait: avec étonnement, puisque la justification par la Michnah précède cette question. Il a donc répété avec étonnement la question et répondu:

[מאי הוי עלה?] כדקאמרינן

Quelle est la loi ? Mais comme nous l'avons dit (plus haut).

Puis pour expliquer le sens de la réponse de Rav Idi bar Avin qui ne fait aucune référence au yayin nessekh, il a ajouté

דלמא חומרא דיין נסך שאני

Peut-être que le cas plus sévère du yayin nessekh est différent.

C'est-à-dire que nous ne pouvons pas nous servir du yayin nessekh (et donc de la Michnah citée) comme preuve de la validité du point de vue d'Abaye. Ce qui introduit en effet les propos de Rav Idi bar Avin.

En conclusion, nous voyons ici une sougya relativement courte dont l'histoire fait intervenir au moins trois générations de sages différentes:

- l'époque de Rav Yossef et de sa décision suite au cas qui est rapporté (et celle d'Abaye[1] qui s'oppose à sa décision),

- la justification par Rav Idi bar Avin du point de vue d'Abaye (sans yayin nessekh)[2]

- l'époque de la justification par la Michnah du point de vue antagoniste d'Abaye (avec la vente de vin à un païen)

- la construction stammaïtique des derniers éléments de la sougya qui articulent les deux justifications différentes (Rav Idi bar Avin et la Michnah) entre elles.

היום יום השואה

 במשך כשלושים שנה אחרי מלחמת העולם השניה, רב ההוגים (כולל הוגים יהודים) לא כתבו על השואה, כמזכיר אלי ויזל בזיכרונות. ובאמת, לא רק ההוגים אלא גם ההיסטוריונים התחמקו מהשואה. המהדורה הראשונה של ספרו של ראול הילברג, The Destruction of the European Jews יצאה לאור בשנת 1961,  ולא זכתה התייחסות רבה בארצות הברית.  רק אחר כך, כהתפתח צורך פוליטי, אז ההתיחסות לארוע הנורא הזה נעשתה שכיחה.

מה נשתנה ?

השאלה נשאלת מבחינה דתית ולא מבחינת העובדות החדשות שנתגלו על ידי החוקרים (אפ''י שהעבודה היסטורית חשובה ביותר).  מה השתנה בעולם ? אם אנו נוטים לענות "העולם כמנהגו נוהג", אז אני אשאל: מה השתנה בעולם היהודי ?

היום, לא מעט הוגים יהודים -אף בני זמן השואה או נצולי השואה עצמם - טוענים כי התורה הזהירה אותנו על השואה ולכן השואה היא סוג עונש על חטא.  הרב סיני אדלר  שעבר את מוראות השואה בספרו בגיא צלמות כותב:

שתי פרשיות בתורה מזהירות אותנו מפני העלול לקרות כאשר עם ישראל יגדיש את הסאה והקב"ה ינהג בו במידת הדין. אחת בפרשת בחוקותי ואחת בפרשת כי תבא. ... גם על הגרוע ביותר הוזהרנו בהמשך גם כל חלי וכל מכה אשר לא כתוב בספר התורה הזאת יעלם ה' עליך עד השמדך. (דברים כ"ח ס"א) חלילה עלולה לקרות גם השמדה. (ע. 121-122)
גם בני לוי ממשיך בדרך הזאת כשהו כותב בספרו Etre Juif:
מה שמתגלה לנו בסובל הבלתי מדיד הזה, הוא שאין לנו מקום פה... והעובדה לא-נמצא-מקום-פה מגלה מיד את המקום שם: מקומו של בן הברית: הר סיני. (ע. 81-82) (התרגום שלי, מצרפתית)
 לפי לוי, השואה היא גילוי ההפוך של מעמד הר סיני - הרבה יהודים היו מסכימים בזה - אבל לוי מצדיק בכך שאין לנו עולם משותף עם הגוים. לכן אורח החיי החרדים מוצדק.
אחרים כמו הרב טיכטל , בעל אם הבנים שמחה, ואחריו הרב י. אשכנזי ("מניטו"), קוראים לעלות לארץ ישראל. אפילו אם אי אפשר להניח באותו מישור את דעות ההוגים האלה  (הבדלים חשובים קיימים ביניהם), עלית הארץ "בעל כוחם" היא תיקון האלהי לאי-רצון עם היהודי להתישב בארץ. אומנם הרב י. טיטלבאום (מחסידות סאטמאר), בעל ויואל משה, קורא להתעלם מין הציונות. אבל כל ההוגים האלא טוענים כי חטא (אי-רצון לקים מצוה מסוימת, או עברה מסוימת או כללית) גרם את השואה.

חלשה בהסברים הללו היא שהם חסרים אובייקטיביות. קל למצוא דוגמה נגדית בכל מקרא. לדוגמה, לא כל היהודים ששרדו את השואה עלו לארץ או אפילו מתכוונים לעלות בכלל. (האם יש לומר בעוז פנים שהם חייבים להיענש עיד?) ההסבר הראשון רק מתכוון לתת פרספקטיבה לגבי העתיד, והיא אינה תחזית ואף אינה מתארת את ההווה, לכן אינה הסבר כלל. בכיוון ההפוך (למי שטוען כי הציונות היא "הסיבה"), לא כל היהודים התקרבו לציונות ואף אפשר לומר שרב קורבנות השואה לא התקרבו לציונות בכלל. 

אבל החלשות העקרית בהסברים הללו היא שהם "הסברים". כלליות זו לא תחזיר לנו את הפסד ולא תחזור אותנו לשלמותנו. ההפך הוא הנכון:  הכללים והכלליות, המוסגים הטהורים וההסברים העיוניים ממשיכים להשתתף באותו העולם  המושפט והאבסטרקטי של הרוצחים: באשר הם מילים בלי ביטוי מוחשי ובלי התגלמות ,הם ממשיכים להפעיל את תפקידם. במקום להחיות את המתים, הם קוברים אותם יותר עמוק.

איך יוצאים מהבנאליות של רוע ? איך מחדשים את המילים ? מאיפה הנחמה ? לשאלות האלא, אינו ניתן לענות בשלומותן. נשמע עכשו שני קולות שונים שמסרבים לתלות את השואה בחטא (בשום הסבר בכלל).
אנו עומדים דוממים לפני תופעת השואה ואין בפינו תשובה. "ואמונתך בלילות"- זהו אחד הניסיונות שמנסה הקב''ה אותנו. למרות הכל, אנחנו ממשיכים לדבוק בקב''ה, בחינת "ברחנו ממך אליך", אבל תשובה, אין !
הוגים מסוימים ורבנים מסוימים מספיקים הסבר ותשובה לכל צרה ואסון. הם יודעים לענות, למשל, למה נהרגו מספר ילדים. פעמים רבות הם תולים זאת בחטאם של אחרים... מוכנות לספק תשובות לעשרה ילדים שנהרגו משמעה סילוק השואה מתודעתנו הדתית. מי שלא סילק את השואה מתודעתו הדתית, לעולם לא יאמר: "יש לי תשובה".   (הרב יהודה עמיטל, מתוך משה מיה: "עולם בנוי וחרב ובנוי")

לבי נבהל בקרבי כאשר אני שומע על הקבלות שעושים בין השואה ובין ארועים טרגיים אחרים בהסטוריה. דווקא בקרב המכובדים והמשפיעים ביותר העוסקים בתיאולוגיה של השואה יש כאלה שלא רואים הבדל משמעותי בין השואה ובין מסעי הצלב האיקוויזיציה וגזרות ת"ח ות"ט למעט ההבדל הכמותי עניין של מספר. כנגד אלה עלינו לקרא בקול גדול שלא כך הדבר. Fukushima, Hillel and Rabbi Nahman miBreslav: במקום שאין אנשים, השתדל להיות איש

Note: Shakla-ve-taria does not usually discuss current headlines. While Shakla ve-taria is a place that definitely welcomes and promotes discussion and debate, it usually presents articles that have matured for a long time. After the announcement today (Thursday, April 21) of a 20 km radius "closed zone" around Fukushima, it was felt however, that we could not keep silent anymore on this disaster.

במקום שאין אנשים, השתדל להיות איש

We shall try to be as honest as possible, however uncomfortable that be.

We are facing an on-going nuclear catastrophe of an unplanned and still unknown magnitude. On the one hand, this kind of accident is not described in the user's manual operating a nuclear power plant nor in any of the models of the nuclear engineers. On the other hand, a number of people have been sounding the alarm for many years now. Their concerns have not been heard -- at least have not been taken into account into a responsible social and environmental policy. The latter fact is hardly new: in virtually any society, there are noble voices that are mostly unheard of, that are sometimes slandered, or deprived of freedom (or even worse). One needs to reach out to these voices, despite the distracting noise of consomption, of seemingly innocent everyday life. These noble voices strive to bring about a real change for others, but they do not expect the whole world to become transparent to itself: their work is never done.

It is therefore disturbing to see that while Japan is on the verge of an even greater disaster, some major vectors of information continue confidently producing the same data, without an inch of critical thought, especially when plenty of people are relying on it.

Most media and even "scientific" sites still rely on the International Commission of Radiation Protection (IRCP). Even for instance the MIT NSE Nuclear Information Hub. If you look up the post on Regulatory Limits on Radiation Dose, dated April 7, you'll see that the author relies on the International Commission of Radiation Protection (IRCP) and its "latest Recommendations on Radiological Protection".  I shall raise two fundamental issues with the IRCP. The first one is philosophical and the second one is very concrete. I shall try to be not too technical.

1. On the first page of the IRCP recommendations, you read


The primary aim of radiological protection is to provide an appropriate standard of protection for man without unduly limiting the beneficial actions giving rise to radiation exposure. This aim cannot be achieved on the basis of scientific concepts alone. All those concerned with radiological protection have to make value judgements about the relative importance of different kinds of risk and about the balancing of risks and benefits. In this, they are no different from those working in other fields concerned with the control of hazards.’
This is indeed disturbing. A body that calls itself "International Commission on Radiological Protection" sets as a fundamental principle that "the primary aim of radiological protection is to provide an appropriate standard of protection for man without unduly limiting the beneficial actions giving rise to radiation exposure." The problem is not that we all know that indeed, the aim of protecting man from radiation "cannot be achieved on the basis of scientific concepts alone". This is indeed true, for there is no agreed-upon definition of what constitutes "protection". But there is neither an agreed-upon definition of what constitutes "beneficial actions giving rise to radiation exposure". Beneficial for whom ? We may agree on some given medical treatment (even though there is usually a lot of scientific debate), for instance, but should we agree on the huge financial benefits provided to the the energy corporations' elite ? Who decides here ? The answer is right here in the first principle: human protection (the concrete protection of people) is acceptable as long as it does not limit the interests of people. In the previous sentence, there is no reason to assume that these are one and the same people. For instance, workers in the nuclear industry (and people living near nuclear power plants) are by definition on the front line. Hard reality, but this is the world we live in, this is the reality as we experience it. As the Michnah (Baba Metsia 83a) puts it plainly:

הכל כמנהג המדינה.
All (contract) according to the custom of the country.

That is, you cannot protest what is fair and what is not in matters of contracts (in this case, hiring workers) from an a priori position. You have to follow (in one way or another) the local custom. Rabbi Yohanan ben Mathia goes even as far as saying to his son (who had hired workers and had included meals for them): "Even if you were to give [the workers] Salomon's meals, you would not have fulfilled your obligation." Do not even think that you can decide yourself a priori what is fair when you hire workers. We always live in a given situation. There is no use to protest against it a priori. Our assessments are relative, not absolute.

However, here, the issue is not the question of fairness. This is a matter of principle. The ICRP is supposed to be a commission on human protection. The problem is that the ICRP distorted its mandate from the very beginning, by taking upon itself the task of, so to say, protecting the benefits of radiation. By "balancing the benefits versus the risks of radiation", the ICRP removes the legal and moral uncomfort that the nuclear industry has to bear. Although the ICRP issues recommendations only, it has a considerable influence on policy-making. Concretely, we all know that had the ICRP simply stated that

The primary aim of radiological protection is solely to provide the best standard of protection for man,
this possibly would not have prevented, in practice, the numerous accidents of the nuclear industry. Admissible levels would have been lower, probably, but in any case, the document is issued only as a recommendation, not law. And even in the many countries where some of it is incorporated into law, law is difficult to enforce in practice.  To sum up: it is possible to argue that the practices of the nuclear industry would have been much the same, but the law would have had a chance to be different. The difference cannot
be overstated. The law would have had a chance to be different.

This analysis does not assume any given political position. We do not claim that a different law would have prevented the accident. This analysis only assumes a certain type of relation to Law.

2.  There are other committees than the ICRP studying the effects of radiations.  There are the United Nations Scientific Committee on the Effects of Atomic Radiation (UNSCEAR), the European Commission and risk agencies in any EU member State (like the Institut de Radioprotection et de Sûreté Nucléaire (IRSN) in France) and the risk agencies in many countries.  I would like to discuss here another one, the European Committee on Radiation Risk (ECRR), which was set up in 1997. The context of the formation of this committee is rather interesting:
The ECRR was formed in 1997 following a resolution made at a conference in
Brussels arranged by the Green Group in the European Parliament. The meeting was called specifically to discuss the details of the Directive Euratom 96/29, now known as the Basic Safety Standards Directive. This Directive has, since May 2000, been EU Law regulating exposure to radiation and to releases to the environment of radioactivity in most countries of the Union. The Euratom Treaty preceded the Treaty of Rome and so once the document had been passed by the Council of Ministers there was no legal requirement for the European Parliament to address it. It was thus cleared without significant amendment although, astonishingly, it contained a statutory framework for the recycling of radioactive waste into consumer goods so long as the concentrations of itemised radionuclides were below certain levels.

One should bear in mind that in terms of policy-making, the ICRP is much more influential than the ECRR. As noted above, many policy-makers rely on the ICRP. However, several of the conclusions of experts in the ECRR directly contradict recommendations of the ICRP and other agencies. However, the ICRP has not included nor discussed so far the contradicting data reported by the ECRR. A debate was held in 2009 between Professor Chris Busby, Scientific Secretary of the ECRR, and Dr Jack Valentin, Scientific Secretary Emeritus of the ICRP (shortly after he resigned from his position). At this  point, we urge the reader to watch and decide for himself. (Busby talks about the first half an hour, then Valentin talks about half an hour and the debate itself starts below approximately at 1h 03' and the reader can alternatively read a short transcript of the debate.)



We shall only discuss briefly one of the issues. A fuller account is available for the courageous reader in the 2010 Recommendations of the ECRR. The model that the ICRP uses (and that is presently used to set legislation on exposure limits) is at best based on the so-called Linear No Threshold (LNT) model. This model does not set a threshold under which the radiation is completely safe but posits (included in the low-dose region) a linear relation between dose and cancer yield. This model is falsified by documented facts, notably many observations of anomalously high levels of cancer and leukemia in populations living near nuclear sites. The alternative model is more complex and takes into account the interaction with DNA. This is absolutely necessary if you take into account internal exposure. Most models currently used predate the discovery of the DNA and do not take into account internal exposure... Why ? At that point, you are compelled to leave the realm of science and to enter that of politics. DNA was discovered in 1953. The effects of radiations on DNA have been studied for a long time now; however, this has not yet given rise to a coherent policy of protection. The politics of radioprotection is a long and tortuous history of secrecy,  Cold War, corporate interests and lobbying, and foreign policy. A complete review is beyond the aim of this article. The bottom line is that the current IRCP recommendations cannot be relied upon. The reader (be he a concerned citizen or a decision maker) is strongly advised to consider the ECRR recommendations instead.

Hence, on the one hand, the recommendations are still recommendations and are not even likely to be implemented soon, and on the other hand, even the ECRR model is by definition provisional, as is any scientific model. Were it not for the on-going disaster in Japan, we might quietly ponder on the temporary validity of scientific models and policy-making. However, given the world we live in, it is not the figure of Karl Popper that comes to our mind at the present time, but one story told by Rabbi Nahman of Bretslav.
A king was once informed by his faithful prime minister that there had been a blight on the crops of that year. They had been so affected that anyone who would eat of the grain would become insane.  "But," said the minister, "there is no need to worry. I have set aside enough grain from last year's harvest for both of us that will last us until the harvest of the following year." However, the king shook his head. "No," he said, "I shall not avail myself of privileges other than those shared by my subjects." He looked at his prime minister. "We shall all eat of the same grain," he continued. "But this is what we shall do. You and I will mark our foreheads with an indelible imprint, so that when we go insane, I will look at you and you will look at me and we will know."

What Rabbi Nahman intended with this story, no one knows for sure, except maybe that in a world that is gone insane, no one can claim to be immune. But we can know that we are insane. We should know.

However, I would like to return to the closed zone around Fukushima. I do not know how many people were evacuated, probably tens of thousands. It is now officially declared a closed evacuation zone. Anyone who would want to live there faces arrest. The meaning is that this 20km radius zone is officially uninhabitable. The implied consequence is that people should flee this place. Of course, this is true. The evacuees' plight is immense. They need help. The future is grim. But I would like to return to Fukushima in a different sense. At the very place where the disaster began, there is no man now -- and for many, many years to come. And according to Hillel in the Michnah (Avot), had there been a man there, the disaster might have been prevented. This, of course, applies to us, in the world we currently live in.

In a place where there are no men, strive to be a man.

Liberté ?

Le Seder de Pessah commence par un appel qui dérange (et qui, par conséquent, rompt avec le "seder", l'ordre):

הָא לַחְמָא עַנְיָא דִּי אֲכָלוּ אַבְהָתָנָא בְּאַרְעָא דְמִצְרָיִם

כָּל דִּכְפִין יֵיתֵי וְיֵיכוֹל

כָּל דִּצְרִיךְ יֵיתֵי וְיִפְסַח

הָשַׁתָּא הָכָא

לְשָׁנָה הַבָּאָה בְּאַרְעָא דְיִשְׂרָאֵל

L'appel (que la tradition a incorporé sous le terme מגיד, "Maguide") est en araméen et non en hébreu, c'est-à-dire la langue vernaculaire, parlée à l'époque du second Temple et pendant les siècles qui sont suivi sa destruction. Il est appel à partager le "pain de misère". Seul l'acte de rompre la matsa pour partager nous engage vers notre libération future. Seul cet acte qui compromet l'ordre ambiant et nous fait basculer dans l'imprévu, dans une responsabilité imprévue, malgré tous nos calculs, nous fait entrevoir la délivrance.

Il est bien connu qu'il existe différentes versions de הא לחמא עניא. En particulier, une des versions manuscrites contient le texte suivant en hébreu

השתא הכא, לשנה הבאה בירושלים

אתמול היינו עבדים והיום בני חורין


A présent ici, l'an prochain à Jérusalem

Hier nous étions esclaves, aujourd'hui (nous sommes) des hommes libres



La version (marocaine) que l'on peut écouter ici incorpore en partie la version ci-dessus. La différence essentielle entre ces deux versions est que dans la première, nous sommes encore esclaves (הָשַׁתָּא עַבְדֵּי), l'année prochaine, nous serons libres (לְשָׁנָה הַבָּאָה בְּנֵי חוֹרִין), alors que dans la seconde, apparemment plus positive, nous étions esclaves  (אתמול היינו עבדים), aujourd'hui nous sommes libres ( והיום בני חורין).

Cette différence a été abondamment commentée par les érudits, notamment en se fondant sur des hypothèses historiques. L'exil hors de la terre d'Israël expliquerait ainsi la première version, où la liberté des hommes n'est évoquée qu'au futur; aussi l'anniversaire de notre soulèvement contre les Egyptiens ne pourrait être fêté complètement. Inversement, les Juifs de retour (ou davantage préoccupés par le retour) en terre sainte seraient plus enclins à prononcer la seconde version, complétée par l'espoir de voir Jérusalem reconstruite.

Cependant, nous préférons voir la force du rituel ailleurs que dans son éventuelle justification historique. La plupart d'entre nous qui suivons ce rituel disons la première version, me semble-t-il. La force de ce passage est qu'il nous interpelle, nous comme esclaves, maintenant. Précisément parce que nous ne sommes pas libres. Dans le monde effrayant dans lequel nous vivons, l'appel du הא לחמא עניא devrait nous interpeller et nous secouer. Malgré la sortie d'Egypte, malgré la sortie de l'idolâtrie, nous ne sommes pas libres. Pas encore. Les raisons contemporaines -- pour qui sait honnêtement les reconnaître -- à notre condition d'aujourd'hui ne manquent pas.  Nous ne sommes donc ni sortis d'Egypte (Mitsrayim) ni sortis de l'idolâtrie. C'est peut-être la grandeur de notre tradition de nous le rappeler si vivement.

Nos sages, avec un humour dont nous avons malheureusement perdu la saveur et dont il ne nous reste peut-être que l'amertume, ne manquent pas d'apprécier la grandeur des civilisations auxquelles ils eurent à faire face. La grandeur de ces dernières ne pâlit qu'en rapport à leur aveuglement. La grandeur de la philosophie grecque n'est-elle pas dans la dignité de son questionnement ? Questionnement qui ne souffre aucun rival, fût-il céleste. Le sage juif est frère de ce questionnement. לא בשמים היא, la Torah n'est pas dans les Cieux, répondent les sages au grand Rabbi Eliezer, lorsque ce dernier semble leur apporter une preuve céleste (Baba Metsia 59b). La recherche de la vérité est souveraine et c'est en cela que réside sa dignité. Nul lieu de questionnement ne peut rester dans l'ombre de la recherche de la vérité, sinon le Lieu des lieux, le point de gloire auquel toute question reste suspendue...  

Les érudits, fidèle à la conceptualisation spinozienne, verront-ils dans cette suggestion une ultime projection d'un souci de contemporain ? Plus loin que la Grèce antique, remonteront-ils jusqu'aux rives du Nil pour reconstituer à partir des affects hébreux la libération d'Egypte ? Qu'importe. הא לחמא עניא, voici le pain de misère que nulle érudition n'a anticipé et qui rompt la certitude du savoir. Nous qui vivont à une époque que nous persistons à appeler moderne savons que le savoir -- ou l'accroissement du savoir -- ne mène pas nécessairement à la liberté. Il se peut que cet enseignement-là soit très ancien. Le savoir ne mène à la liberté que s'il est précédé d'un partage plus grand. Ces paroles appellent aujourd'hui, maintenant, à des actes concrets à l'égard de l'étranger, actes dépourvus de certitude, en-dehors des catégories de pensée que nous avons patiemment élaborées. Sinon raconter la sortie d'Egypte n'est qu'une supercherie. L'enseignement du מגיד est précédé du יחץ. Les paroles qui visent à la connaissance ne viennent qu'après le bris de la Matsah -- préparée כהלכה dans la hâte et pourtant si longtemps attendue. מצה שמורה, Matsah chemourah, -- bien entendu ! --, c'est-à-dire pain azyme que nous avons si jalousement gardé... et qu'il faut briser à présent. Liberté.

Le souvenir de la sortie d'Egypte nous rappelle que cette liberté-là -- qui fut celle de nos ancêtres -- reste à conquérir.

כֹּה אָמַר יְהוָה, זָכַרְתִּי לָךְ חֶסֶד נְעוּרַיִךְ, אַהֲבַת כְּלוּלֹתָיִךְ--לֶכְתֵּךְ אַחֲרַי בַּמִּדְבָּר, בְּאֶרֶץ לֹא זְרוּעָה.

Emmanuel Levinas et la pensée religieuse

L'Occident, depuis la Révolution française, s'est construit sur une séparation de la foi et du savoir, ouvrant l'espace de la laïcité qui fut longtemps comprise dans l'exclusion du religieux. Mais Emmanuel Levinas parle, dans Difficile Liberté, d'une "religion d'adultes" loin de la croyance naïve en un Dieu qui habiterait les arrière-mondes. La lecture aujourd'hui de cet grand penseur nous permet de dépasser la coupure entre foi et savoir et de nous approcher de ce qui "suppose le désintéressement de la bonté, le désir de l'absolument autre ou la noblesse, la dimension de la métaphysique".

Un colloque international à Toulouse en 2006 a réuni diverses personnalités sur la pensée religieuse de Levinas à l'occasion du centième anniversaire de sa naissance. Les différents horizons religieux (juifs, catholiques, protestants) des participants ont concouru à un débat particulièrement riche. J'ai eu la joie d'y participer et de présenter à ma manière une page du Talmud. Les contributions de ce colloque sont aujourd'hui rassemblées dans un ouvrage qui fait une belle part à l'interrogation toujours vivante sur les noeuds de la pensée et du religieux.

La justification de la loi par David Weiss Halivni

Voices yet to be heard

A collective book on Jewish women and the sexual violence they faced during the Shoah, edited by Sonja Hedgepeth and Rochelle Saidel, deserves our attention.  Here is an excerpt of a review by Elissa Strauss in the Forward:

At the end of their workshop about women in the Holocaust at Yad Vashem in 2006, scholars Sonja Hedgepeth and Rochelle Saidel encountered some dissent. The presentation, “Beyond Anne Frank: Teaching About Women and the Holocaust,” looked at the ways in which women experienced the Holocaust differently than men did, and included a discussion on sexual violence at Ravensbrük. Afterward, a few of the conference attendees, including a pre-eminent Holocaust scholar, said there was no evidence on this subject and questioned whether sexual violence had really occurred.
As an answer, Hedgepeth and Saidel got working on the recently published “Sexual Violence Against Jewish Women During The Holocaust” (Brandeis, 2010), the first book on the topic in English, which comprises 16 essays examining the rape, forced prostitution, sexual slavery, forced abortion and sterilization that took place during the war.
While the Holocaust has been examined from myriad perspectives in both academia and popular culture, sexual violence, which was largely directed against women, has received little attention. Hedgepeth and Saidel, along with a small group of academics and writers, are fighting to change that.
“This has been totally neglected in the history of the Holocaust,” Saidel said, explaining that there has been a resistance overall to looking at survivors’ experiences in terms of gender. “For some historians, focusing on women means that you are taking away from the totality of the Holocaust experience.”
“For some,” Hedgepeth added, “there is a false perception that looking at sexual violence is asking the question of who suffered more.”

Startling is the statement that some "historians" questioned whether sexual violence occurred during the Shoah. Unfortunately it did occur -- and to levels unprecedented in history.

The (excellent) review points out rightfully several of the (difficult) questions that such work entails. It is both surprising and instructive to observe that
rape was not among the charges against Nazi war criminals during Nuremberg and other trials. In fact, rape was not considered a crime of genocide by the United Nations until 1998, when it was made so through the International Criminal Tribunal for Rwanda.
For some reason, the reviewer felt the need to include, as a concluding remark, that "a truth of history can keep us from repeating its suffering". Nothing in the world can warrant this.

Since this statement appears quite often in several (disguised or not) forms, this may be the place to state precisely why it should be objected. Yes, most of the victims yearned for the truth to be told, they desired with all their heart and all their soul that the truth be heard.  There is no reason to suppose that victims of sexual violence feel differently. But one essential reason why their voices were/are so repressed or difficult to hear is that justice cannot be done. Those who chose to speak had no choice but to engage in the world as it is. Those who truly desire to keep history from repeating its suffering (or increase them) have no choice but to act in this world as it is. Otherwise no truth of history is so compelling that it collectively prevents us from inflicting suffering to others.

Despite all the great scholars' and historians' works, the true impact on present politics is marginal. We are remembered the sobering remark of R. Hilberg (In "The Politics of Memory"): only when the politics sought a gauge with which to measure their own atrocities in foreign affairs (the US War on Vietnam), only then it became "possible" to talk about the holocaust. No truth of history is so compelling that it cannot become an instrument. We would do well to remember this as well. There is no doubt that one of the co-authors of the book, Rochelle Saidel, has a particularly acute understanding of the "politics of memory". And even knowing history of the "politics of memory" will not keep us (or our executive representatives)  from repeating the same passive or active mistakes in our day.

What is the value of scholarship then ? What is the value of all the great efforts of these scholars ? Is there not already plenty of documentation ? The facts may be documented and overwhelming, but they can also be twisted and manipulated. Or simply ignored. Yes, the scholar may freely choose history as goal per se. Indeed, this is how Aristotle defines history as defining man as man. But undoubtedly, as a woman (or man)living in this world, she faces a serious dilemma. What should her own priorities be ?

This being said (and left unanswered), I add, in the words of the great scholar Yerushalmi,
If this be the choice, I will take my stand on the side of `too much' rather than `too little', for my terror of forgetting is greater than my terror of having too much to remember. Let the accumulated facts about the past continue to multiply. Let the flow of books and monographs grow, even if they are only read by specialists. Let unread copies lie on the shelves of many libraries, so that if some be destroyed or removed, others will remain. So that those who need can find that this person did live, those events really took place, this interpretation is not the only one. So that those who may someday forge a new halakhah may sift and retrieve what they require.
